Risicato Designs Terms and Conditions

Prefix

Due to the custom nature of our business, these terms and conditions have been developed to be as transparent as possible regarding our operation.

All orders placed to Risicato Designs by any means, including but not limited to phone, email, in-person, or online orders are subject to these Terms and Conditions.

Any service or product, including artwork created by Risicato Designs and offered at no cost, is also subject to these Terms and Conditions.

Orders

Definition

Orders include any service or product purchased or enlisted through Risicato Designs LLC.

Order Acceptance

Orders will be accepted via phone, email, in-person, or online. Accepted orders are subject to full payment as outlined.

Payment Terms

• General Payment: Full payment is required unless agreed otherwise. Delay may result in service delays.
• Due on Receipt: Payment is due when product/service is completed or received.
• Net 15: Payment due 15 days after the invoice date.
• Net 30: Payment due 30 days after the invoice date.

Failure to Make Payment: Non-payment may result in account hold or collection service after 125 days.

Order Approval

All custom orders require customer approval before production.

Pricing

Pricing is subject to change during approval. If payment is made before a correction, we will contact you to resolve any differences.

Art Approval Policy

Printing and Color

The customer understands that due to the differences between digital displays and physical materials, slight color variations may occur during the printing process. Every effort is made to match colors as accurately as possible based on approved proofs. However, due to limitations in digital rendering and the variety of materials we print on (e.g., cotton, polyester, paper, vinyl), exact color replication cannot be guaranteed.

Colors viewed on a digital screen (phones, tablets, monitors) may appear differently than the printed result due to individual screen calibration, brightness, and display technology. In addition, various factors—such as the print method used (e.g., screen printing vs. sublimation vs. DTF), the base color of the garment or substrate, and environmental conditions like humidity and temperature—can all affect the final printed color.

Because of these factors, colors may print slightly lighter, darker, warmer, or cooler than expected. For brand-critical or color-sensitive projects, Risicato Designs recommends requesting a physical sample prior to full production. Once a proof has been approved and sent to production, changes to color cannot be made, and Risicato Designs is not liable for minor color variations between the approved proof and the finished product.

Proofing

Final proof approval releases Risicato Designs from typographical or color issues. If our error deviates from approved proof, we will correct it.

Order Fulfillment

Standard production time is 10 business days after proof and payment. Delays may occur and do not qualify for refund unless a specific date was pre-approved.

Rush service may be available for an added fee. Shipping times are additional.

Artwork

Risicato Designs Created Content

All artwork created by Risicato Designs remains our property unless rights are specifically granted. Unauthorized reproduction is prohibited.

Website Artwork

Website artwork is property of Risicato Designs or its affiliates and cannot be reproduced without permission.

Plagiarism

Do not send us content you do not have rights to. Customers are fully responsible for the content they provide.

Cancellation and Returns

Statement

We aim for full customer satisfaction and will review claims on a case-by-case basis. Contact us to begin the return process.

Return Process

• Prior authorization is required.
• No returns accepted after 30 days from receipt.
• No returns/cancellations on custom items unless error is ours.
• Returned items must be in original condition.
• Shipping costs are non-refundable unless the issue is ours.

Vinyl Warranty & Adhesion

Products are sold as-is without warranties unless stated otherwise. Vinyl life varies and is not guaranteed. Testing prior to use is recommended.

3rd Party Installs

Third-party installations void any warranty. We cannot control the conditions of external installs.

Adhesion Problems

Surface compatibility is the customer’s responsibility. We recommend requesting a sample if unsure.

Damage of Property

We are not liable for property damage caused by our products. Test products before applying.

Shipping

We ship via USPS, UPS, and FedEx. Unless otherwise specified, standard ground or USPS priority is used.

Package Theft

Risicato Designs is not liable for theft after delivery. For added security, request signature confirmation prior to shipment.

Online Designer

Logos, artwork, and designs created or uploaded through Risicato Designs’ Online Designer tool will be produced (printed or embroidered) in accordance with our standard practices regarding logo size, placement, and alignment. If you have specific size, placement, or positioning requirements, you must contact Risicato Designs prior to placing your order through the Online Designer. We are not responsible for discrepancies between customer expectations and our production standards if no prior communication is made.

Designs may be adjusted to meet print or embroidery requirements—including but not limited to resizing, color adjustments, or simplification for embroidery. These adjustments are made based on industry best practices to ensure quality output. Such adjustments do not constitute grounds for return, refund, or reproduction without cost.

If a customer wishes to receive a proof for review prior to production or requires specific design modifications (e.g., resizing, repositioning, or advanced edits), a graphic design charge may be applied. This fee is determined on a case-by-case basis depending on the complexity of the request. Any additional charges will be communicated to the customer before work begins.

Please note that colors viewed on your screen during the Online Designer experience may differ slightly from the final product due to variations in screen brightness, calibration, print method, and material used. We strive to match colors as closely as possible, but minor variance between digital previews and physical results is expected and does not qualify as a production error.

Reasonableness

By using our products or services, you agree these terms are reasonable and accept limitations on liability.

Other Parties

As a limited liability entity, you agree not to bring claims personally against our officers or employees for losses. These limitations protect our staff and affiliates.

Unenforceable Provisions

If any term is unenforceable by law, the rest of the terms remain in effect.

Indemnity

You agree to indemnify Risicato Designs LLC from any losses or claims resulting from your breach of these terms.

Law and Jurisdiction

These terms are governed by U.S. law and disputes fall under the jurisdiction of Dupage County, IL courts.
